Age Discrimination Laws

There are several regulations that aim towards the protection of the rights of older employees against age discrimination.In the year 1967, the Equal Employment Opportunity Commission or EEOC enforced the Age Discrimination in Employment Act or ADEA. This act safeguards not only the professional rights of the employees, but also covers job applicants, both falling in the age bracket of 40 years or above. The act prohibits the employers from discriminating against older employees with regard to granting jobs, promotion, discharge, compensation, or the benefits of employment. This act has to be adhered to by all companies having a minimum of 20 or more staff members. Apart from private organizations, the state and federal governments are also required to follow the norms of the law. The law strictly prohibits laying down age as a specification in job advertisements or making any age related enquiries during interviews. The only exception to this rule is in the case of occupations where age is a bona fide occupational qualification. It is also regarded illegal to practice age discrimination in apprenticeship programs. Moreover, the law clearly outlines that the company cannot take any legal action against an older employee filing charges for age discrimination.
In the year 1975, the Civil Rights Center put forth the Age Discrimination Act of 1975 that takes into consideration the prevention of any age bias pertaining to federal financial support. The same establishment also enforced Section 188 of the Workforce Investment Act of 1988. This section aims at safeguarding the professional benefits of applicants, employees and participants in WIA Title I-financially supported programs and activities.
The year 1990 saw another achievement of the older employees in terms of the Older Workers Benefit Protection Act or OWBPA. The act stressed on protection of the benefits of employment of the older employees. Recognizing the exceeding cost of providing work benefits to older employees as one of the reasons for age discrimination, the Congress granted permission to the employers to curtail certain benefits of the older employees ensuring that the total cost of benefits offered to the old and young employees remains the same.
