Types Of Age Discrimination
Age discrimination designates a situation wherein an individual is denied his or her due, solely on the criteria of age. The term in general refers to discrimination against the older age group. However, the term encompasses discrimination against the youth as well. |
This type of discrimination is known as reverse age discrimination’ and falls under the jurisdiction of state laws. As for the elderly, there are federal laws that protect them against any age bias.The most prevalent forms of age discrimination are denial of appropriate job opportunity. Many worthy candidates are denied of jobs on pretext of age since companies focus on earning profits by recruiting younger and more energetic employees. Such cases can be taken to court if the older person has credentials to prove his or her superior professional potential in comparison to the younger candidate employed instead.
Another related type of age discrimination involves denial of promotion due to age. As a direct consequence of age discrimination, many senior employees are not given an equal opportunity to rise in their professional set ups. These also form valid charges with the same requirements of genuine better competency to be furnished by the older employee. Salary based discrimination is also fairly common in companies. Despite putting in the same amount of toil or working hours, at times due to age factor many are denied equal pay structures. If the qualifications and experience of two employees is the same and yet there exists a wage discrepancy, then age discrimination can be proven valid.
A variant of age discrimination exists in the property sector as well. Certain communities uphold the Housing for Older Persons Act, HOPA. This act prohibits those under the age of 55 from owning or residing in a particular area. Thus, no charges can be filed in cases of housing based age discrimination if the property falls under HOPA. Elsewhere, all individuals have equal rights to own property.
Similarly, victims of age discrimination in employment can file lawsuits under the provision of Age Discrimination in Employment Act or ADEA. However, as per the ruling of US Supreme Court in 2004, winning the case is only a possibility if the victim is above the age of 40. As for cases of property, no age restriction is enforced. The only aspect to be kept in mind is that the property being contested should not be under HOPA.
