Temporary Disability Rights
When talking about disability rights, people generally assume about disability during birth or long term disability due to accidents, injury or some critical illness.
However, disability that results in a lack of performance for a short span of time is called temporary or short term disability.It may be required for an employee to take an off on the professional front in case of some illness or emergency. This falls under short term disability. The duration can be a few weeks unlike long term disability which extends between a few months to a couple of years or even a lifetime.
The government has passed an act in 1992 called Family and Medical Leave Act which protects the job of the employees who take leave to address some medical emergencies. Organizations having more than 50 employees should provide the temporary disability benefits by the law to the workers.
In case of short term disability, the employee would still be compensated for a specified amount of time without a loss in the payment even after the sick leave is exhausted. The benefits are generally valid after a period of absence from the professional front for at least a week.
When the temporary disability benefits period begins, the benefits depend on the duration for which the employee has served for the company and his responsibility in the growth of the organization. A percentage of the gross salary is paid to the individuals during this time.The duration of temporary disability benefits varies between organizations. Generally, the eligibility varies between 13 and 26 weeks.
