Finally the damages that have been caused by the breach of contract are determined and this process takes place only after the breach of contract has been established.

When a contract breach o fiduciary duty takes place, the aggrieved party is always entitled to damages, and the attorney fees can be covered in some cases provided the breach of contract by the fiduciary has been proved.
